The Psycho Ex-Wife: Free Speech Fight Over Divorce Blog

On Tuesday, the "Today Show" took a look at "The Pyscho Ex-Wife," a website launched by divorcee Anthony Morelli in 2007 as a forum to air his frustrations about his divorce and contentious child custody dispute.
Morelli's foray into the blogosphere triggered a free-speech debate after Judge Diane Gibbons ordered him to take down the site in June 2011, citing the emotional damage it could cause Morelli's two minor children, whom he and his ex-wife share custody of.
Morelli insists that his blog serves as therapeutic catharsis rather than vindictive crusade.
"I tried to provide a forum, where, through [the] collective experiences [of my readers], we could help minimize the conflict in our lives, and choose better ways to deal with our high-conflict ex-spouses--be they men or women," he said.
But his ex-wife, Allison Morelli, told the "Today Show" that the emotional hurt caused by the site is so great that even their two children have asked their father to take it down.
"[The kids] have asked their father to stop and I know that they've told him that it has a negative effect on me," she said.
Though he removed his blog at the order of Judge Gibbons, Morelli is appealing the ruling on grounds that it violates his First Amendment rights.

On June 6, 2011 Judge Diane E. Gibbons has violated Mr. Anthony Morelli's first amendment rights to Free Speech and Freedom of the Press, by ordering him to close down a website that he created to explain to the world what is happening in cases of divorce in the United States of America, and how governments interfere in the lives of families and attempt to destroy parental equal parenting rights and the children's rights to have a relationship with both parents.
The international Organization known as Action For Justice ( AXJ ® ) has had to protest and uphold Mr. Morelli's rights to Freedom of Speech and of the Press.
Everything expressed on this website around the world is simply an opinion and protected by the First Amendment of the Constitution of the United States of America.

On July 1st, 2011 – the attorney filed a Motion for Reconsideration with Family Court Judge, Diane E. Gibbons.
The motion was very specific in that we were requesting that the trial court’s order of June 6th, 2011 and any subsequent orders based upon the June 6th order be vacated as they related to speech and/or the website www.thepsychoexwife.com.

A notice and courtesy copy was hand-delivered on July 1st, 2011 as time was of the essence. The final date to file an appeal of the decision to a higher court was July 6th, 2011.
Judge Diane E. Gibbons waited until late in the day on July 6th, 2011 to notify her acceptance of the motion and ordered a hearing to be undertaken on August 15th, 2011.

Due to the 11th-hour notification that the Motion for Reconsideration had been granted, we were left with no choice but to file our notice of appeal to the higher court. This was done on July 6th, 2011 – the last day on which we were able to file. (See: Concise Statement of Matters Complained of on Appeal)
On July 8th, 2011 – the law firm received word of Judge Diane E. Gibbons’ intention to cancel the reconsideration hearing in light of the decision to move ahead and file for the appeal.
Draw your own conclusions.
A letter was subsequently faxed to Judge Diane E. Gibbons asking her to reconsider her decision to cancel the hearing.

It is our understanding that the hearing has, in fact, been canceled and we must move ahead with the appeals process.
