The Psycho Ex-Wife: Free Speech Fight Over Divorce Blog

On Tuesday, the "Today Show" took a look at "The Pyscho Ex-Wife," a website launched by divorcee Anthony Morelli in 2007 as a forum to air his frustrations about his divorce and contentious child custody dispute.

Morelli's foray into the blogosphere triggered a free-speech debate after Judge Diane Gibbons ordered him to take down the site in June 2011, citing the emotional damage it could cause Morelli's two minor children, whom he and his ex-wife share custody of.

Morelli insists that his blog serves as therapeutic catharsis rather than vindictive crusade.

"I tried to provide a forum, where, through [the] collective experiences [of my readers], we could help minimize the conflict in our lives, and choose better ways to deal with our high-conflict ex-spouses--be they men or women," he said.

But his ex-wife, Allison Morelli, told the "Today Show" that the emotional hurt caused by the site is so great that even their two children have asked their father to take it down.

"[The kids] have asked their father to stop and I know that they've told him that it has a negative effect on me," she said.

Though he removed his blog at the order of Judge Gibbons, Morelli is appealing the ruling on grounds that it violates his First Amendment rights.

Check out a clip from the "Today Show" segment and weigh in: Does Morelli's right to free speech outweigh the purported harmful effect of the blog on his children?

AXJ ® has stated the following:

To protect children and families around the world.

On June 6, 2011 Judge Diane E. Gibbons has violated Mr. Anthony Morelli's first amendment rights to Free Speech and Freedom of the Press, by ordering him to close down a website that he created to explain to the world what is happening in cases of divorce in the United States of America, and how governments interfere in the lives of families and attempt to destroy parental equal parenting rights and the children's rights to have a relationship with both parents.

The international Organization known as Action For Justice ( AXJ ® ) has had to protest and uphold Mr. Morelli's rights to Freedom of Speech and of the Press.

On July 1st, 2011 – the attorney filed a Motion for Reconsideration with Family Court Judge, Diane E. Gibbons.

The motion was very specific in that we were requesting that the trial court’s order of June 6th, 2011 and any subsequent orders based upon the June 6th order be vacated as they related to speech and/or the website www.thepsychoexwife.com.

A notice and courtesy copy was hand-delivered on July 1st, 2011 as time was of the essence. The final date to file an appeal of the decision to a higher court was July 6th, 2011.

Judge Diane E. Gibbons waited until late in the day on July 6th, 2011 to notify her acceptance of the motion and ordered a hearing to be undertaken on August 15th, 2011.

Due to the 11th-hour notification that the Motion for Reconsideration had been granted, we were left with no choice but to file our notice of appeal to the higher court. This was done on July 6th, 2011 – the last day on which we were able to file. (See: Concise Statement of Matters Complained of on Appeal)

On July 8th, 2011 – the law firm received word of Judge Diane E. Gibbons’ intention to cancel the reconsideration hearing in light of the decision to move ahead and file for the appeal.

    Draw your own conclusions.

A letter was subsequently faxed to Judge Diane E. Gibbons asking her to reconsider her decision to cancel the hearing.

It is our understanding that the hearing has, in fact, been canceled and we must move ahead with the appeals process.

    ANTHONY MORELLI APPEALS AGAINST CENSORSHIP

ANTHONY MORELLI APPEALS AGAINST CENSORSHIP IN THE USA

Judge orders husband to take down blog about his 'terroristic psycho ex-wife'

Last updated at 10:48 PM on 9th August 2011

When 42-year-old Anthony Morelli got divorced from his wife, he didn’t just get mad - he got even.

Mr Morelli of Bucks County, Pennsylvania started a blog in which he heaped scorn upon his ex-wife and laid bare the secrets of their marriage.

Amongst the more choice insults for his former partner were that she looked like ‘Jabba the Hut’ and ‘suffers from Borderline Personality Disorder’.

The Ex-Files: Anthony Morelli has been forced to take down 'outright cruel' blog which alluded to his ex-wife having a drinking problem and mental disorder

‘She’s on the precipice of 40 and probably looks all 50-years of it,’ he wrote elsewhere, adding for good measure that she was ‘terroristic’.

www.thepsychoexwife.com attracted more than 200,000 followers a month and was so successful Mr Morelli was able to start selling advertising off of it.

But it all came to an end when his ex-wife Allison found out about it and complained to a judge who ordered the blog be taken down.

Rosier times: the Morellis before he considered his wife 'terroristic' and 'psycho'

Mr Morelli, who shares custody of his two sons aged 10 and 12 with his ex-wife, lost a court battle over the decision but has now appealed on the basis that it challenges his First Amendment Rights.

He has now started a new blog, www.savethepsychoexwife.com, to get donations to fight his legal battle.

Mr Morelli, of Bucks County, Pennsylvania, has said that he hopes his website is an inspiration to others not to ‘get trapped’ like he did.

‘The site is intended to help people in similar situations,’ he said.

‘I felt that it was a way for me to tell the truth of my experiences but to no one in particular.’

Mr Morelli stared the blog, which did not actually name his ex-wife, by claiming it was a ‘true account of a marriage, divorce, and subsequent (child) custody fight between a loving man, his terroristic ex-wife who we suspect suffers from Borderline Personality Disorder (at least from our armchair psychologist diagnosis), and the husband's new partner.’

Happy family: The couple have two sons, aged 10 and 12

He does not name his ex-wife but refers to her as the PEW, and encouraged readers to send in their own similar horror stories.

‘Imagine if you will, Jabba The Hut, with less personality. She spends her time ... drinking her days away bemoaning her victim status, when she isn’t stuffing the children with fast food, buying them toys, or pushing them towards the TV or computer.’

Earlier this year Buck County Family Court Judge Diane Gibbons ordered Mr Morelli close down the blog which she said tipped over into ‘outright cruelty’.

But he has now hired a lawyer and challenged that order to continue to be allowed to update it.

Unimpressed: Ms Morelli thinks her ex-husbands blogging is not the best thing for their children

‘The judge’s order is a classic example of an overly broad and unenforceable prior restraint on free speech,’ said his lawyer Kevin Handy.

‘The order is constitutionally over broad because it clearly prohibits speech that is protected by the First Amendment.’

Ms Morelli, 42, has said she just wants the entire episode to be over with.

‘What the judge said in court made perfect sense to me. Stop doing what you're doing, and do the right thing for your children,’ she has commented.
